Terms of service

1. Agreement

By accessing or using Peeka (peekaai.com), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the service.

These Terms constitute a legally binding agreement between you and Peeka in accordance with applicable e-commerce and consumer protection law.

2. Service Description

Peeka is an AI-powered video and image generation platform. Users can create videos by providing text descriptions, uploading reference images, or picking one-tap effects, and can create still images the same way. The service uses third-party AI models to generate content based on user inputs.

The platform includes an asset library for managing uploaded media, a credit-based billing system, public video sharing, and a referral program.

2.1 Upstream Model Provider Disclosure. The underlying video generation capability is provided by an enterprise third-party AIGC model provider. Peeka acts as an integration and distribution layer; it does not modify, retrain, or fine-tune the upstream model weights. The upstream provider's content policy, real-person detection, NSFW detection, copyright detection, and other moderation systems apply to every generation request made through Peeka. The upstream provider's content policy may be updated by the upstream provider at any time without notice to Peeka users; such updates take effect immediately upon being applied by the upstream provider.

2.2 Generated Content Disclaimer. Video content is generated based on user-supplied prompts and reference assets. Neither Peeka nor the upstream model provider warrants, expressly or impliedly, the accuracy, originality, legality, fitness for any particular purpose, non-infringement, or commercial usability of any generated content. The user assumes full responsibility for the use, publication, distribution, and commercial exploitation of generated content.

2.3 Service Availability. Service availability is subject to the upstream provider's network, quota, content moderation systems, and operational status. Peeka does not commit to any specific uptime, latency, or throughput SLA. For task failures caused by upstream service interruptions, Peeka's liability is limited to refunding the credits already charged for the affected task in accordance with the Refund Policy. Peeka is not liable for indirect, incidental, consequential, or punitive damages including but not limited to delayed content schedules, contract breaches, lost profits, or reputational harm.

2.4 Upstream Provider Final Decisions. The upstream model provider reserves the right to refuse, terminate, or delete any task that violates its content policy. Such decisions are final and binding; the right of final interpretation belongs to the upstream provider. Peeka has no authority to override these decisions and will not represent to users that it can. When an upstream moderation decision affects your task, we tell you that the task was turned down and the general reason (for example, a safety or copyright check), in our own words, and the credits charged for that task come back automatically. Users who believe an upstream decision is in error may submit an appeal to contact@peekaai.com; Peeka will forward the appeal to the upstream provider on a best-effort basis but cannot guarantee any specific outcome or response time.

2.5 Cross-Border Data Transfer. By using the service, you acknowledge and consent that text prompts, uploaded images, generation parameters, and metadata associated with your generation requests will be transmitted to the upstream model provider's servers located in Asia-Pacific jurisdictions (Singapore / Hong Kong region) for processing, content moderation, and inference. If your jurisdiction (including but not limited to those governed by GDPR, PIPL, CCPA, or similar regimes) imposes specific requirements on cross-border personal data transfer, you must not upload reference assets containing personal data of any individual without first obtaining adequate legal basis and consent. Peeka may retain operational logs of requests (excluding image and video content) for fraud prevention and billing reconciliation purposes for up to twelve (12) months, as described in our Privacy Policy.

3. Accounts and Registration

Eligibility: You must be at least eighteen (18) years old to use Peeka.

Guest Access: You may make one (1) free clip with a one-tap effect without creating an account. Guest usage is tracked by a unique guest identifier and IP address. Guest clips carry a small "peeka" mark.

Registration: To continue using the service beyond the free guest video, you must create an account with a valid email address. Email verification is required to activate your account. New accounts get a one-time sign-up bonus of ten (10) credits, limited to one per person. Disposable email addresses do not qualify, and we may pause the bonus for the rest of a day when a daily limit is reached.

Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at contact@peekaai.com if you suspect unauthorized access to your account. You are liable for all activity that occurs under your account.

One Account Per Person: Each individual may maintain only one account. We reserve the right to suspend duplicate accounts.

4. Credits and Payment

Video generation is powered by a credit-based system. Credits are purchased in AED and consumed when generating videos, images, or other AI outputs.

Pricing: Per-video credit costs, top-up plan amounts, the current AED-to-credit exchange rate, and any API discounts are published on the /recharge page and may be updated from time to time as upstream costs change. The pricing displayed on /recharge at the time of purchase is the binding price for that transaction.

General Terms:

• All prices are displayed in AED (AED) and are inclusive of 5% VAT where applicable.
• Payments are securely processed by Stripe in accordance with PCI DSS standards. We do not store your credit card information.
• Credit purchases are one-time transactions, not recurring subscriptions. No automatic renewals apply.
• Purchased credits do not expire and remain in your account until used.
• Credits are non-refundable except as specified in our Refund Policy.
• Credits earned through the referral program are subject to the same usage terms as purchased credits.
• We reserve the right to change pricing at any time. Existing credit balances are not affected by price changes.

5. Referral Program

Peeka offers a referral program that allows registered users to earn credits when people they refer use and buy Peeka. The program has a single tier: you earn only from people you refer directly, never from the people they refer. The main reward is 20% of a referred user's qualifying purchase, paid in credits (not cash). The minimum purchase for the 20% reward, the smaller fixed rewards and the monthly partner bonus are set out on the Referral Program Terms page.

The referral program is designed to comply with applicable law and is not a pyramid or multi-level marketing scheme. Full terms are available in our Referral Program Terms.

6. User Content and Intellectual Property

Generated Videos: You retain ownership of videos generated using Peeka based on your inputs. By using the service, you grant Peeka a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your generated content solely for the purpose of operating and providing the service (including public share pages).

Uploaded Content: You are solely responsible for ensuring that any images, videos, or audio files you upload do not infringe on the intellectual property rights, privacy rights, or other rights of any third party. You represent and warrant that you have all necessary rights and permissions for content you upload.

AI-Generated Reference Images: Images generated through Peeka's image generation feature are produced by AI models and provided for use as inputs to video generation. You retain rights to use the resulting outputs subject to these Terms; Peeka does not assert ownership of generated images you create.

Real People and Faces: You may use photos of yourself, or of people who have agreed to appear in what you make; our one-time face check is optional. You may not create content showing a real person without their permission, you may not show public figures, and you may not use images of anyone under 18. Clips made with a friend require each person's own consent.

AI Labelling: Content made with Peeka is AI-generated. When you share it, don't remove any AI-generated labels or present it as real footage of real events.

Watermark: Clips made as a guest carry a small "peeka" mark. The mark may not be removed, obscured, or altered.

7. Asset Library

Peeka provides an asset library where you can upload and manage images, videos, and audio files for use in video generation. Uploaded assets are stored on Peeka servers.

You are solely responsible for the legality of all content you upload to the asset library. Peeka reserves the right to review, remove, or disable access to any content that violates these Terms, applicable laws, or the rights of third parties, without prior notice.

8. Video Sharing

Peeka provides public share pages for generated videos at URLs in the format peekaai.com/v/{id}. You may share your videos via WhatsApp, X (Twitter), Facebook, and LinkedIn through the platform's sharing features.

By sharing a video publicly, you consent to its public visibility and acknowledge that anyone with the link can view the shared video. You are solely responsible for the content of videos you choose to share publicly.

9. Acceptable Use

You agree to use Peeka in compliance with all applicable laws and regulations, including those governing cybercrime, online media, and content. Prohibited uses are detailed in our Acceptable Use Policy.

10. AI Content Disclaimer

• Peeka uses third-party AI models to generate video content. AI-generated output may contain inaccuracies, artifacts, or unexpected results. We do not guarantee the accuracy, quality, or appropriateness of any generated content.
• You are solely responsible for reviewing all AI-generated content before publishing, sharing, or using it for any purpose.
• You must not use Peeka to create deepfakes or any content that deceptively impersonates real individuals without their consent.
• Where required by the laws of your jurisdiction, you must clearly disclose that content was generated using artificial intelligence.
• AI-generated content may not accurately represent real people, places, brands, or products. Any resemblance is unintentional unless explicitly intended by your input.
• Content moderation is provided on a best-effort basis. Peeka does not guarantee that all prohibited content will be detected or blocked.

11. Service Availability

Peeka is provided on a best-effort basis. We do not offer any service level agreement (SLA) or guarantee of uptime. The service may be temporarily unavailable due to scheduled maintenance, updates, system failures, or circumstances beyond our control.

We will endeavor to provide advance notice of planned maintenance when feasible. We are not liable for any losses resulting from service interruptions.

Regions: The AI models behind Peeka are only offered in certain countries and regions. Creating videos and images is not available when you are located outside those regions (for example, in India or France); you can still browse the site and view shared content. You may not use a VPN or other means to get around this restriction.

12. Disclaimer of Warranties

THE SERVICE AND ALL AI-GENERATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Peeka EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that: (a) AI-generated content will be accurate, complete, or error-free; (b) the service will be uninterrupted or secure; (c) generated content will be suitable for any particular use; or (d) generated content will comply with all applicable laws in your jurisdiction.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CONSUMER PROTECTION LAW, Peeka SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO PEEKA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Peeka, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the service; (b) content you generate, upload, or share; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

15. Termination

By You: You may stop using the service at any time. You can delete your account yourself in Account, Profile & security, or ask us to delete it at contact@peekaai.com. Tax invoices for your purchases are kept for the period the law requires, as described in our Privacy Policy.

By Us: We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the service or other users.

Effect of Termination: Upon termination for violation of these Terms, any remaining credits in your account are forfeited and non-refundable. Upon voluntary account deletion where no violation has occurred, credits are forfeited unless otherwise specified in our Refund Policy. Your obligation to pay any outstanding amounts survives termination.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of competent courts.

17. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' advance notice via email or a prominent notice on the platform before the changes take effect. Your continued use of the service after the effective date of any changes constitutes your acceptance of the updated Terms.
